29 CFR  1903.19(c)(1): The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated:   a) On or about 07/09/2025:  The employer did not provide abatement certification for items within the settlement agreement required to abate Citation 01, Item 001 which became a final order on May 20, 2025.  An abatement demand letter was sent to the employer on June 27, 2025.  Abatement certification is required for this item.

29 CFR  1926.503(a)(2):The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii):  a) 5955-5965 Calm Lakes Lane, Farmington, NY  14425. on the roof, on or about 10/23/24:  Workers were exposed to fall hazards while working at height without having been trained by a competent person on the hazards associated with falls in construction and on the methods for protecting workers from the same.  Abatement certification must be submitted for this item.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) 5955-5965 Calm Lakes Lane, Farmington, NY  14425. on the roof, on or about 10/23/24:  Workers were installing roofing materials onto a 6:12 pitch roof with a ground to eave height of 13 feet without fall protection.  JJ Home Improvement 1 Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926.501(b)(11), which was contained in OSHA inspection number 1742586, citation number 1, item number 1 and was affirmed as a final order on 9/6/24, with respect to a workplace located at 224 Ideal Street, Buffalo, NY  14206.
