29 CFR 1910.146(c)(1): The employer did not evaluate the workplace to determine if any spaces were permit-required confined spaces: a) On or about October 29, 2024, and at times prior, the employer did not effectively evaluate the workplace and identify germination rooms as permit-required confined spaces. When in use, germination rooms may contain carbon dioxide which creates a potentially hazardous, oxygen deficient atmosphere. Entry into oxygen deficient environments may result in respiratory distress, loss of consciousness, and suffocation.
