29 CFR 1910.178(l)(6): The employer did not certify that each operator had been trained and evaluated as required by paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation: a) Facility Wide- On or about October 30, 2024, the employer did not certify that each employee who operates the powered industrial vehicles was trained and evaluated to perform tasks safely. The operators were not trained in-house and the employer relied on training received from their previous employers. b) On or about October 30, 2024, the employer did not certify that each employee who operates the powered industrial vehicles was trained and evaluated to perform tasks safely. The operators were not trained in-house and the employer relied on training received from their previous employers. c) On or about October 10, 2024, the employer failed to train an operator who operated a fork truck in an unsafe manner, thereby exposing employees to struck-by injuries. A forklift operator, not trained by the employer, loaded a pallet on a rack and it pushed a pallet on the other side of the aisle that fell on the floor. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.178(q)(7):Industrial trucks shall be examined before being placed in service and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. On or about October 30, 2024, the employer did not ensure that powered industrial trucks were examined daily for conditions that could adversely affect the truck's safety before being placed into service. Employees operated lift trucks to move various materials throughout the facility. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
