29 CFR  1926.602(d): Powered industrial truck operator training.  Note: The requirements applicable to construction work under this paragraph are identical to those set forth at paragraph (l) of 29 CFR 1910.178(l):  29 CFR  1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  a. Located at 9014 Hawk Hill Way, Plain City, Ohio 43064: On or about October 30, 2024, an employee was operating a rough-terrain forklift to raise framing materials. The employer did not ensure that the employee had been trained and evaluated to operate the forklift, thereby exposing employees to struck-by hazards.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a. Located at 9014 Hawk Hill Way, Plain City, Ohio 43064: On or about October 30, 2024, the employer failed to ensure an employee was protected against fall hazards of approximately 11 feet while framing the second story of an under construction residential home.

29 CFR  1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a. Located at 9014 Hawk Hill Way, Plain City, Ohio 43064: On or about October 30, 2024, the employer did not provide a fall protection training program to ensure that employees, engaged in framing activities during the construction of a residential home, were protected from fall hazards while working at heights of approximately 11 feet.
