29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation. On or about October 31, 2024, an employee was installing a tracer wire to locate the drainage pipes for a golf course development at Grand Geneva Resort and Spa in Lake Geneva, WI in a trench excavation that had an accumulation of water and adequate precautions had not been taken to protect employees from the increased risk of cave-ins posed by the accumulation of water.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. On or about October 31, 2024, the competent person found an accumulation of water at the bottom of a trench which increased the likelihood of a possible cave-in where employees were installing drainage pipes and tracer wire for locating the drainage pipes and the exposed employees were not removed from the hazardous area until the necessary precautions such as installing cave in protection where employees were working in and/or near the edge of the trench.
