1926.20(b)(2)  The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person.  On or about November 1, 2024, employees engaged in commercial construction activities at the Beacon construction site located at 200 S 14th Street, Omaha, Nebraska, were exposed to crushing and struck-by hazards related to working beneath the placement boom.  The project used a Putzmeister MXR 36/40Z Placing System (comprised of a 115-foot boom assembly) and approximately a 20-foot tall, 4-foot by 4-foot steel lattice tower to deliver concrete to the 14th floor the parking garage project.  The lattice tower was located on the northeast area on the 12th floor of the parking garage and ran vertically through the 13th and 14th floor.  The pump operator extended MXR 36/40Z Placing System boom approximately 115-feet to the south portion of the building.  A 4-person crew was positioned on the concrete formwork on the 14th floor approximately beneath the boom and hose to direct the concrete across the formwork.  Two tower base anchors on the north side of the tower failed and caused the tower to lean to the south in the direction of the extended boom which caused the end of the 115-foot boom to fall onto the concrete formwork.  One employee suffered a traumatic head injury when he was struck-by the boom as it fell onto the concrete deck.
