29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) 1452 Tudor Way, Farmington, NY  14425, on the roof, on or about 10/31/24: Workers were installing roofing material onto a two story residential structure, with two roof levels, both 4:12 and ground to eave heights of  9 and 18 feet without fall protection.

29 CFR  1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.   a) 1452 Tudor Way, Farmington, NY  14425, on the roof, on or about 10/31/24: Workers were installing roofing material onto a two story residential structure, with two roof levels, both 4:12 and ground to eave heights of  9 and 18 feet without fall protection and where a monitor system could have been utilized, however was not.  The employer was unable to articulate the application of a monitor system for fall protection.    Abatement certification must be submitted for this item.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   a) 1452 Tudor Way, Farmington, NY  14425, accessing the upper roof, on or about 10/31/24: Workers were using an extension ladder to access a 4:12 pitch roof at 18 feet from ground where that ladder did not extend at least three feet above the upper landing.    b) 1452 Tudor Way, Farmington, NY  14425, accessing the lower roof, on or about 10/31/24: Workers were using an extension ladder to access a 4:12 pitch roof at 9 feet from ground where that ladder did not extend at least three feet above the upper landing.
