29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.   a) On or about 07/16/2025:  The employer did not provide abatement certification for items within the settlement agreement required to abate Citation 01, Item 002 which became a final order on May 27, 2025.  An abatement demand letter was sent to the employer on June 27, 2025.  Abatement certification is required for this item.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) 6411 County Route 41, Farmington, NY  14425, on the main roof, on or about 10/31/24:  Workers were installing roofing materials onto a 6:12 pitch roof and a 12:12 dormer, with a ground-to-eave height of 26 feet, without fall protection.    a) 6411 County Route 41, Farmington, NY  14425, on the lower roof, on or about 10/31/24:  A worker was installing roofing materials onto a 4:12 pitch roof and an 8:12 pitch roof, with a ground-to-eave height of 13 feet, without fall protection.

Abatement documentation must be submitted for this item.
