29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: a) South of the intersection of Colorado Blvd. and 70th Ave., Along Colorado Blvd., west of 6990 Colorado Blvd., Commerce City CO: On or about November 4, 2024, and at times prior, employees were allowed to enter a trench without any of these necessary precautions in place. The trench was measured to be approximately 6 feet 4 inches deep.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): a) South of the intersection of Colorado Blvd. and 70th Ave., Along Colorado Blvd., west of 6990 Colorado Blvd., Commerce City CO: On or about November 4,2024, and at times prior, and at times prior, employees were exposed to cave in hazards while working in an unguarded trench with vertical walls at depths of approximately 6 feet 4 inches.
