29 CFR 1910.28(b)(3)(iv):29 CFR 1910.28(b)(3)(iv): The employer did not provide that each employee be protected from falling into a ladderway floor hole or ladderway platform hole by a guardrail system and toeboards erected on all exposed sides, except at the entrance to the hole, where a self-closing gate or an offset must be used. a) Lignetics of New York, 1580 Airport Road, Deposit, 14551, Second Floor Metering Bin Mezzanine. On or about 10/29/2024, employees were exposed to a fall hazard of approximately 10 feet when the fixed ladderway used to access the second floor mezzanine was without protection from falling onto the lower level. The ladderway did not have a self-closing gate and/or was not offset.

29 CFR 1910.134(c)(2)(i):Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: a) Lignetics of New York, 1580 Airport Road, Deposit, 14551. On or about 10/29/2024, the employer did not provide employees with the information contained in Appendix D of the Respiratory Protection Standard ("Information for Employees Using Respirators When Not Required Under the Standard"), when the employer permitted employees to use a 3M Model 8511, N95 Filtering Face-Piece Respirator.
