29 CFR  1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met.  a) On or about and at times prior to November 5, 2024, at the establishment located at 1910 Cofrin Drive, Green Bay, Wisconsin; the employer did not develop and implement a written hazard communication program when employees worked with hazardous chemicals in the workplace, such as but not limited to brake cleaner, compressed gases, and WD-40, exposing employees to the hazards associated with hazardous chemicals.  All provisions of 29 CFR 1910.1200(e) through (h) must be contained in a written hazard communication program. Key elements include, but are not limited to the following:  1) Complete collection of SDS 2) List of all hazardous chemicals 3) Container labeling 4) Employee information and training

29 CFR  1910.1200(f)(6): Except as provided in paragraphs (f)(7) and (f)(8) of this section, the employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with either: (i) The information specified under paragraphs (f)(1)(i) through (v) of this section for labels on shipped containers; or, (ii) Product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.   a) On or about November 5, 2024, at the establishment located at 1910 Cofrin Drive, Green Bay, Wisconsin; the employer did not ensure that each container of hazardous chemical was labeled, tagged or marked, with the identity and/or hazards of its contents, exposing an employee to chemical hazards. One container that contained WD-40 was not properly labeled, tagged or marked.

29 CFR  1910.1200(g)(1): Chemical manufacturers and importers shall obtain or develop a safety data sheet for each hazardous chemical they produce or import. Employers shall have a safety data sheet in the workplace for each hazardous chemical which they use.  a) On or about and at times prior to November 5, 2024, at the establishment located at 1910 Cofrin Drive, Green Bay, Wisconsin; the employer did not have a safety data sheet (SDS) in the workplace for each hazardous chemical which they used. The employer did not have an SDSs for compressed gases, such as but not limited to acetylene, argon, and oxygen.

29 CFR  1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  a) On or about and at times prior to November 5, 2024, at the establishment located at 1910 Cofrin Drive, Green Bay, Wisconsin; the employer did not ensure that employees working with hazardous chemicals in the workplace, such as but not limited to brake cleaner, compressed gases, and WD-40, were provided information and training on the hazardous chemicals, exposing employees to chemical hazards.

29 CFR  1910.1026(d)(1): Each employer who has a workplace or work operation covered by this section shall determine the 8-hour TWA exposure for each employee exposed to chromium (VI). This determination shall be made in accordance with either paragraph (d)(2) or paragraph (d)(3) of this section.  a) On or about and at times prior to November 5, 2024, at the establishment located at 1910 Cofrin Drive, Green Bay, Wisconsin; the employer did not determine the 8-hour TWA exposure for an employee exposed to chromium (VI) while welding on stainless steel, exposing an employee to health hazards associated with chromium (VI).
