(a) On or about November 6, 2024, at a worksite located at S66 W14325 West Janesville Road, Muskego, WI 53150, the employer did not ensure that an adequate protective system was used in a seven (7) foot deep trench to protect employees from potential trench collapse hazards while removing and installing sewer lines.

29 CFR 1926.652(b):The slopes and configurations of sloping and benching systems were not in accordance with the requirement options of 29 CFR 1926.652(b)(1), (b)(2), (b)(3), or (b)(4): (a) On or about November 6, 2024, at a worksite located at S66 W14325 West Janesville Road, Muskego, WI 53150, the employer did not bench the excavation correctly for type C soil, in-that the southwest side of the excavation was benched at three (3) feet vertical and 1 ft 8 inches or 20 inches horizontally, and the northeast side of the excavation was benched at three (3) feet vertical and 1 ft 4 inches or 16 inches horizontally. After the benching, the depth of the excavation was four (4) feet. The inadequate benching exposed employees to cave-in hazards.

(a) On or about November 11, 2024, at the worksite located at S66 W14325 West Janesville Road, Muskego, WI 53150, the competent person had not performed a daily inspection of excavation to protect employees from being exposed to possible cave-in hazards.

29 CFR 1926.651(j)(2): Employees shall be protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. (a) On or about November 11, 2024, at the worksite located at S66 W14325 West Janesville Road, Muskego, WI 53150, the employer did not ensure that spoil pile was at least two (2) feet from the edge of excavation, exposing employees to a struck-by hazard from potential falling soil.
