OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from physical assault by patients exhibiting threatening and violent behavior, resulting in serious injuries while working at Community Resources for Justice, Inc: On or about October 26, 2024, and continuing thereafter, employees providing residential care and transportation services were exposed to physical assaults by patients who exhibited aggressive behavior such as issuing threats and who were known to pose a risk to themselves and others. The physical assaults occurred while staff were performing their job duties and included punching, pushing, throwing objects, and strangulation. On October 26, 2024, a patient residing at a group home located at 2 Pine Street, Paxton, MA threatened and strangled a Residential Counselor (RC) who was operating a motor vehicle while transporting the patient. As a result of the suffocation, the RC lost consciousness. The RC was hospitalized for four days due to serious injuries including a broken neck and required 70 days away from work.

The alternate incident report form used for 2024 OSHA 300 Log, Case 02, dated 10-26-2024, recordable due to a work-related injury resulting in hospitalization and days away from work, was not equivalent to Form 301 in that the form does not include: Form 301, Item 8 - Was employee treated in an emergency room?
