29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: On or about November 7, 2024, and at times thereafter, the employer did not implement the written respiratory protection program established for the worksite for employees required to wear respirators when operating the Q-line bagger for protection against respirable crystalline silica. The employer had not fully implemented the requirements of medical evaluations, proper use of respirators in the workplace, and documenting fit test records with all required information.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: On or about November 7, 2024, and at times thereafter, the employer had not provided medical evaluations to employees required to wear respirators when operating the Q-line bagger for protection against respirable crystalline silica to determine their ability to use a respirator prior to its first use in the work environment. Note: The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.

29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function: On or about November 7, 2024, the employer did not ensure that employees who were required to wear N95 filtering facepiece respirators when working on the Q-Line bagger were clean shaven to allow for a good facepiece to skin seal. Employees were exposed to chemicals such as respirable crystalline silica which is included in products such as but not limited to blended mason mix and concrete mix.
