29 CFR  1926.1101(h)(2)(i):The employer failed to implement a respiratory protection program in accordance with 29 CFR 1910.134(b) through (d) [except (d)(1)(iii)], and (f) through (m), which covers each employee required by 29 CFR 1926.1101 to use a respirator:  a) 737 Main Street Bethlehem, PA - On or about November 7, 2024, employees performed class II asbestos work involving the removal of ACM floor tile. The employer's respiratory protection safety program, which covered employees that wore half-mask elastomeric respirators (7700 series ? face respirator) did not provide training for employees that was accessible for employees who spoke Spanish and also did not have a specified administrator listed within the contents.  b) 737 Main Street Bethlehem, PA - On or about November 7, 2024, employees performed class II asbestos work involving the removal of ACM floor tile. Employees were required to use half-mask elastomeric respirators (7700 series ? face respirator) and the employer did not have an implemented schedule of respirator cartridge changes nor cleaning as based on usage in the written respiratory program in accordance with this section.  c) 737 Main Street Bethlehem, PA - On or about November 7, 2024, employees performed class II asbestos work involving the removal of ACM floor tile. Employees that were required to use half-mask elastomeric respirators (7700 series ? face respirator) did not have fit testing prior to usage in accordance with this section.
