29 CFR 1926.503(c): The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section: a) On or about November 5, 2024, employees were exposed to an approximate 55-60-foot fall hazard while installing new LED light fixtures on the ledge of a five-story building without any means of fall protection. b) On or about November 5, 2024, an employee was exposed to an approximate 55-60-foot fall hazard while walking on a roof structure of a five-story building without any means of fall protection. Note: Circumstances where retraining is required include, but are not limited to, situations where (1) Changes in the workplace render previous training obsolete; or (2) Changes in the types of fall protection systems or equipment to be used render previous training obsolete; or (3) Inadequacies in affected employees knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.
