OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crush-by and struck-by hazards during the operation of a powered industrial truck without the use of restraint systems (seatbelts) or which did not have restraint systems (seatbelts) installed. a) 2292 Victory Highway Burrillville, Rhode Island: On or about November 9, 2024, the employer did not ensure that Powered Industrial Truck drivers were using seatbelts exposing employees to serious physical harm or death. National consensus standard ASME B56.1-1993 requires the use of an operator restraint system when equipped on a powered industrial truck.
