OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees are constantly walking/working in between the damaged pallet rack uprights and supports. Location: 355 Food Center Dr. Building G Bronx, NY 10474 On or about: November 12, 2024 a) Damaged pallet rack uprights and supports were not taken out of service, repaired or replaced before material stored in them. Employees were exposed to struck by and/or crushing hazard. b) Pallet racks failed to display in one or more conspicuous locations a plaque to permanently and prominently display the permissible loading of the rack. Employees were exposed to struck by and/or crushing hazard.

Location: 355 Food Center Dr., Building G, Bronx, NY 10474 Southern end of the building On or about: November 11, 2024 a) CSHO observed one worker performing work near the edge of the concrete walkway by the trash compactor. The height of the concrete walkway measured approximately 5-6 feet in height. Worker exposed to a fall hazard.

Electrical tape used as permanent repair for damaged insulation exposing wires. Workers exposed to electrical shock.
