29 CFR 1910.67(c)(2)(v):(v) A personal fall arrest or travel restraint system that meets the requirements in 29 CFR part 1910, subpart I, was not worn and attached to the boom or basket when working from an aerial lift: a)Pebble Beach Landscaping at 41st Street and Western Avenue, Sioux Falls, SD 57105: On or about and at times prior to November 8, 2024, the employer did not ensure that employees were utilizing a personal fall arrest system while operating the Haulotte 5533A Articulated & Telescopic Trailer Aerial boom lift during holiday light installation on a commercial property. This condition exposed employees to a fall hazards. Pebble Beach Landscaping was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.67(c)(2)(v), which was contained in OSHA inspection number 1635841, citation number 1, item number 1 and was affirmed as a final order on April 21, 2023 with respect to a workplace located at 27112 Cardinal Drive, Harrisburg, SD 57032.
