OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that they were exposed to stuck-by and crushing hazards of collapsing storage rack systems with severe structural damage. a) Warehouse: On or about 11-12-2024, employees were exposed to struck-by and crushing hazards of falling loads and steel storage racking system components due to the employer not ensuring the storage racks were structurally sound and free of damage. Warehouse aisle racking systems such as, but not limited to, racks marked #1 and #2 that were loaded with material, had damaged cross braces, bent upright columns and base plates.
