29 CFR 1910.23(c)(11): The employer did not ensure that portable ladders used to gain access to an upper landing surface that have side rails that extend at least 3 feet (0.9 m) above the upper landing surface: a) Facility - On or about November 7, 2024, an employee was exposed to fall hazards of approximately 8 feet 9 inches when utilizing a portable self-supported 10 foot Werner A-Frame ladder to get on the top of the Chiller approximately 8 feet 9 inch in height from the ground. The 10 foot A-Frame ladder does not provide the employee with side rails to utilize to access the top of the Chiller.

29 CFR 1910.30(c)(3): The employer did not retrain an employee when inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicated that the employee no longer had the requisite understanding or skill necessary to use equipment or perform the job safely: a) Facility - On and prior to November 7, 2024, an employee was exposed to fall hazards of approximately 8 feet 9 inches when working on the top of a Chiller (P3718) when using inadequately rated anchorage points, utilizing a portable self-supported 10 foot A-Frame ladder that does not provide the employee with side rails to utilize to access the top of the Chiller, and the employee detaching from the anchorage points to walk across the top of the Chiller unit. The employer did not retrain the employee that demonstrated inadequacies in the knowledge or use of the fall protection systems that need to be utilized when accessing and walking and working on top of the chiller unit.
