29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  (a) Volodymir Sapizhak dba VSV Construction failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected:   Citation 1, Item 2 a serious violation of 29 CFR 1926.501(b)(13) with an abatement date of January 17, 2025.  Citation 2, Item 1 a other-than-serious violation of 29 CFR 1926.503(b)(1) with an abatement date of January 17, 2025.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets.  (a) On or about November 13, 2024, at a jobsite located at 1080 E. Mary Lane, Oak Creek, WI 53154, the employer did not ensure the employee assisting in roofing operations (ground worker) was protected from potential falling objects from above by the use of a protective helmet. This exposed the employees to a struck-by hazard from a height of up to approximately 18 feet 3 inches.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  (a) On or about November 13, 2024, at a jobsite located at 1080 E. Mary Lane, Oak Creek, WI 53154,  employees installing a roof on an existing residential home with an approximately 7:12 pitch were not using fall protection. This exposed employees to a fall hazard of approximately 18 feet 1 inch from the roof eve to the ground below on the left (west) side of the home.

Mary Lane, Oak Creek, WI 53154, the employer did not verify fall protection training by preparing a written certification record for employees tasked with installing a roof on a new residential home.
