29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). On or about November 13, 2024, at a facility located at 605 North Ohio Street in Merrill, Wisconsin; the employer did not ensure that an employee operating powered industrial truck forklifts was competent to operate the equipment through the completion of training and evaluation as specified in paragraph (l).
