29 C.F.R. � 1926.501(b)(13) states, Residential construction. Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  Graber & Sons Construction, LLC does not ensure employees are protected from fall hazards of 6 feet or greater by guardrail systems, safety net systems or personal fall arrest systems. Nor does Graber & Sons provide alternative fall protection measures consistent with � 1926.501(b). The employer does not require the use of any form of fall protection during roofing work. This violation was most recently observed on November 13, 2024 while performing framing work at a residential construction site in Savoy, Illinois, as follows:  a.  One employee was not protected from fall hazards of 8 feet from the second story top-plate to the second story floor. b.  One employee was not protected from fall hazards greater than 10 feet from the second story top-plate to the first story floor and exterior of the building.  c.  One employee was not protected from fall hazards of 10'-3" from the second story floor to the first story floor. d.  Two employees were not protected from fall hazards greater than 10 feet from the second story window opening to the exterior of the building. e.  Two employees were not protected from fall hazards of 8 feet from the window opening in the exterior wall at the stairway landing leading from the first story to the second story.  To abate this violation, the Graber & Sons Construction, LLC must ensure that its employees performing roofing work are protected from falls and that no employee is permitted to engage in residential construction activities 6 feet or more above lower levels without a guardrail system, safety net system, or personal fall arrest system in compliance with 29 C.F.R. � 1926.501(b) at all future worksites. Furthermore, should the employer establish that the exception set forth in 29 C.F.R. � 1926.501(b)(13) applies, then fall protection must be provided in accordance with 29 C.F.R. � 1926.502(k).    Pursuant to 29 C.F.R. � 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance including a description of how these steps protect employees from fall hazards.
