29 CFR 1910.29(b)(13)(i): The guardrail system opening used around holes that serve as points of access (such as ladderways), did not have a self-closing gate that slides or swings away from the hole, and was equipped with a top rail and mid rail or equivalent intermediate member that met the requirements in paragraph (b) of this section: a) Tech Production Area - Employees are not protected from a fall of about 9.5 feet above a lower level from an unguarded ladder opening, on or about January 7, 2025. No abatement certification or documentation required.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: a) Throughout - The employer did not obtain written approval from the forklift manufacturer to use a mixing bowl attachment, on or about January 7, 2025. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
