29 CFR 1926.451(g)(1)(vii):Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. a) 2159 Sachs Ave., Toms River, NJ: Employees were exposed to a fall hazard. A worker while drywalling utilized a scaffold and plank to gain access to a fourteen feet high balcony. Once on the other side the employee would pull the plank over to the balcony. The employee leaned on a rail on the balcony which subsequently gave way. The employee fell and sustained serious injuries to his head from the concrete floor. Observed on or about 11/14/24 NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.454(a)(1):The employer failed to have each employee who performs work while on a scaffold trained regarding the nature of any electrical hazards, fall hazards and falling object hazards in the work area. a) 2159 Sachs Ave., Toms River, NJ: Employees were exposed to a fall hazard associated with no training on scaffolds. A worker while drywalling utilized a scaffold and plank to gain access to a fourteen feet high balcony. Once on the other side the employee would pull the plank over to the balcony. The employee leaned on a rail on the balcony which subsequently gave way. The employee fell and sustained serious injuries to his head from the concrete floor. The injured employee had not received any training on scaffold as it pertains to fall protection. Observed on or about 11/14/24 NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
