At a temporary worksite located at 1008 North Central Avenue in Flagler Beach, Florida:  On November 14, 2024, the employer exposed employees to struck-by hazards to the eyes, caused by flying particles, in that eye protection was not utilized by employees while operating pneumatic nail guns to install roofing materials.

At a temporary worksite located at 1008 North Central Avenue, Flagler Beach, Florida:  On or about November 14, 2024, the employer exposed employees to fall hazards, in that, the employees were accessing the roof via a stair railing 38.4 inches without a ladder to access and exit the roof while conducting roofing work.

While accessing a second story 6:12 pitched roof, at a temporary worksite located at 1008 North Central Avenue in Flagler Beach, Florida:  On November 14, 2024, the employer exposed employees to fall hazards, in that an unsecured non-self-supporting extension type ladder was placed on the slant/peak of the first floor roof and was utilized by employees to enter and exit the second story roof, while conducting roofing work.  b. While accessing a second story 6:12 pitched roof, at a temporary worksite located at 1008 North Central Avenue in Flagler Beach, Florida:  On November 14, 2024, the employer exposed employees to fall hazards, in that an unsecured fiberglass self-supporting A-Frame type ladder was placed on the slanted first floor roof and was utilized by employees to enter and exit the second story roof, while conducting roofing work.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, a personal fall arrest system, or an alternative fall protection measure as provided by another provision in paragraph (b) of this section:   a.	The employer does not maintain an effective program, including frequent and regular inspections by competent persons designated by the employer, to ensure that workers use fall protections in compliance with 29 CFR 1926.501(b)(13), as demonstrated on November 14, 2024, when employees installing roofing materials on the second-story 6:12 pitch roof of a residence located at 1008 North Central Avenue in Flagler Beach, Florida, were exposed to fall hazards ranging from 8 to 24-feet, in that the employees are not protected by, or utilizing any form of fall protection systems.  Florida's Best Roofing, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1490709, Citation Number 1, Item Number 1, and was affirmed as a final order on February 24, 2021, with respect to a workplace located at 32 Wentworth Lane, Palm Coast, FL 32164.

29 CFR 1904.41(a)(2):  The establishment had 20 or more employees but fewer than 250 employees at any time during the previous calendar year, and the establishment was classified in an industry listed in appendix A to subpart E of this part, and the employer did not electronically submit information from OSHA Form 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee by the specified date:  a.	Florida's Best Roofing, Inc. located at 1 Enterprise Drive, Unit 4, Bunnell, Florida:  On or about March 3, 2025, the employer failed to electronically submit information from their OSHA Form 300A, Summary of Work-Related Injuries and Illnesses, or its equivalent form, for calendar year 2024, on or before March 2, 2025. The establishment employed approximately 24 employees and was classified in the North American Industrial Classification System as 238160 during calendar year 2024.
