29 CFR 1926.602(d): Powered industrial truck operator training. Note: The requirements applicable to construction work under this paragraph are identical to those set forth at 1910.178(1) of this chapter. 29 CFR 1910.178(l)(1)(ii) Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer did not ensure that each operator has successfully completed the training required by this paragraph (1), except as permitted by paragraph (1)(5). On or about October 13, 2023 and times prior to, Lindsey Construction was installing roof trusses at a jobsite located at 905 West Walnut Street in Ellington, Missouri. The employer did not ensure operators of a Class VII variable reach rough terrain forklift, Lull, model 644D, were trained in the safe operations of the powered industrial truck. Employees were exposed to fall hazards while working inside Haugen attachment model MWP4x8, serial # M0014535.

29 CFR 1926.602(c)(1)(ii): Modifications or additions affecting the safe operation of the equipment were made without the manufacturer's written approval: Note: If such modifications or changes were made, the capacity, operation, and maintenance instruction plates, tags, or decals should have been changed accordingly: On or about October 12, 2023, Lindsey Construction was installing trusses at a jobsite located at 905 West Walnut Street in Ellington, Missouri. The employer did not ensure manufacturer written approval was obtained prior to utilizing a Haugen basket attachment MWP4x8, serial # M0014535, to lift employees into elevated work area to install the roof trusses. Employees were exposed to struck by and fall hazards.
