29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: This violation occurred on November 13th, 2024, at 1515 Business Loop E Jamestown, ND, when the employer did not establish and maintain a continuing, effective hearing conservation program where employees were not provided baseline audiograms, annual audiograms, and training for employees welding on steel who were exposed to occupational noise equaling or exceeding an 8-hour time-weighted average of 85 decibels. (a) A welder was exposed to continuous noise levels at 89.1% of the permissible 8-hour time-weighted average (TWA). The equivalent decibel (dBA) level of 89.1% is approximately 89.1 dBA. Sampling was performed for 378 minutes during one shift. (b) A Welder was exposed to continuous noise levels at 134.4% of the permissible 8-hour time-weighted average (TWA). The equivalent decibel (dBA) level of 134.4% is approximately 92.1 dBA. Sampling was performed for 413 minutes during one shift.
