29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program that included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):    At the job site located at 801 Iowa Str. Lawrance, Kansas, the employer failed to develop written hazard communication program to describe how the program would be implemented to include training, labeling, and the administration of safety data sheets, to address their chemicals such as the hazards of QuikRete concrete mix and Dryvit which could cause severe skin burns and serious eye damage, prolonged or repeated inhalation of dust may cause lung, along with allergic reactions, genetic defects and cancer.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:   At the jobsite located at 801 Iowa Str. Lawrance, Kansas, employees were exposed to chemical hazards. Employees performing stucco work were exposed to dermal, ingestion, and inhalation hazards from exposure to hazardous chemicals without being provided with information and training on how to recognize, avoid and/or eliminate the hazards associated with the QuickRete concrete mix and Dryvit.

Lawarence, Kansas, employees engaged in stucco activities were exposed to fall hazards while walking/working from a fabricated framed scaffold that was not fully planked or decked. Employees were exposed to fall hazards of approximately 12 feet from the working level of the scaffold to the ground below.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:   At the jobsite located at 801 Iowa str. Lawarence, Kansas, employees engaged in applying stucco to an exterior wall of the building with the use of fabricated scaffold were exposed to fall hazards of up to 12 feet from the working platform to the ground below. The employees were exposed in that a complete guardrail system or other fall protection system was not in place to keep them from falling.
