All repairs shall be made by authorized personnel. a) On and before 11/19/2024, the employer did not ensure that the Drexel forklift (Designation D-44, Model DREXEL SL-44/3-ESS-E Electric Forklift , Serial # 17775-7-17) was in safe operating condition or removed from service on 10/07/2024 in that employees were operating the forklift without a functioning horn. Last observed on 11/19/2024

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. a) On and before 11/19/2024, the employer did not ensure the Drexel forklift (Designation D-44, Model DREXEL SL-44/3-ESS-E Electric Forklift , Serial # 17775-7-17) was removed from service after a shift inspections conducted on 10/07/2024 and 11/11/2024 thru 11/14/2024 showed that the horn was not operable. Last observed on 11/19/2024.

29 CFR 1910.178(l)(6): Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation. a) On or about 11/19/2024, the employer did not ensure that an employee who operates a Toyota forklift (Model:5FGC25 S/N:79107) had documentation certifying the employee had been trained and evaluated to operate forklifts.
