29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds shall be fully planked or decked between the front uprights and the guardrail supports as follows:  a) Worksite, 1115 Main St., Fishkill, NY, scaffold erected in front of building:  On or about November 19, 2024, the employer did not ensure that all working levels of the tubular welded frame scaffold used by employees were fully planked. Employees were performing brick work on the fourth tier of the first section of a tubular welded frame scaffold. The working level had two wood planks approximately 18 inches wide. The working level was not fully planked.  the employees were exposed to falling approximately 28-feet to the ground.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access:  a) Worksite, 1115 Main St., Fishkill, NY, scaffold erected in front of building  - On or about November 19, 2024, employees were accessing  the fourth level of the  tubular welded frame scaffold approximately 28-feet above by climbing the walk through frames and crossbraces. employees were not provided with  access to the scaffold platforms.

29 CFR  1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level:  a) Worksite, 1115 Main St., Fishkill, NY, scaffold erected in front of building:  On or about November 19, 2024, an employee performing brick work on the fourth tier of the first section of a tubular welded frame scaffold approximately 28-feet above the ground and was not provided with any means of fall protection.  b) Worksite, 1115 Main St., Fishkill, NY, scaffold erected in front of building:  On or about November 19, 2024, employees performing brick work on the fourth tier of the third section of a  tubular welded frame scaffold, were not provided with adequate fall protection. The employees were exposed to a fall of up to 28 feet above the ground.
