29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a. On or about November 20, 2024, the employer failed to ensure that employee(s) who operate a Crown sit-down forklift and Crown electric pallet jack were properly trained, evaluated and certified to perform the tasks in a safe manner, thereby exposing employees to struck-by hazards.

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service:  a. On or about November 20, 2024, in the facility, employees were required to operate the Crown sit-down forklift and the Crown electric pallet jack on a daily basis. These powered industrial vehicles were not regularly examined prior to use to verify their condition.
