29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a. On or about November 20, 2024, at 2930 Drane Field Road, Lakeland, Florida, 33811, employees were wearing N95 respirators, half-face respirators and full-face/supplied-air respirators while applying chemicals such as spray paint and lacquer thinner and metal cleaner to pieces of aluminum, during which time the employees had not been medically evaluated to determine the employee's ability to use a respirator; therefore exposing the employees to respiratory hazards.
