29 CFR  1910.28(b)(1)(i):Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  (a)Marmen Energy Co. at 1820 North Plum Avenue, Brandon, SD 57005: On or about and at times prior to November 20, 2024, the employer did not ensure employees performing work on the interior of elevated tower sections in the Door department were protected from fall hazards to the exterior of the tower sections in that an appropriate fall protection system was not impended. This condition exposed employees to fall hazards greater than four feet.

29 CFR  1910.212(a)(1):One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  (a)Marmen Energy Co. at 1820 North Plum Avenue, Brandon, SD 57005: On or about and at times prior to November 20, 2024, the employer did not ensure employees were protected from struck-by and pinch point hazards related to movement of the Superior Crane Corp 30 Ton gantry crane (Serial #18200) along the runway rails. Appropriate guarding was not provided along the length of the runway. This condition exposed employees to struck-by and pinch point hazards.  (a)Marmen Energy Co. at 1820 North Plum Avenue, Brandon, SD 57005: On or about and at times prior to November 20, 2024, the employer did not ensure employees operating ROU204 were protected from pinch-point hazards created between the roller and tower collar during rotation in that the roller guard was damaged exposing the point of operation, the contact point between the roller and the tower collar. This condition exposed employees to pinch-point and caught-in hazards.
