OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:  a) automotive dismantling bay lift# 1: On November 20, 2024, and at times prior, the employer exposed employees to crush-by hazards while operating the 2-post automotive with structural damage and a disconnected/non-functional travel limit switch.   b) automotive dismantling bay lift# 2: On November 20, 2024, and at times prior, the employer exposed employees to crush-by hazards while operating the 2-post automotive with structural damage and a disconnected/non-functional travel limit switch.  c) automotive dismantling bay lift# 3: On November 20, 2024, and at times prior, the employer exposed employees to crush-by hazards while operating the 2-post automotive with a disconnected/non-functional travel limit switch.  d) automotive repair bay lift# 5: On November 20, 2024, and at times prior, the employer exposed employees to crush-by hazards while operating the 2-post automotive with a disconnected/non-functional travel limit switch.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):   a)  Facility Wide; On or about November 20, 2024, at at times prior, the employer exposed employees to struck-by hazards in that employees were allowed to operate a powered industrial truck without the employer first ensuring the employee was competent to operate the equipment as demonstrated by the completion of the required training and evaluation specified by the regulation.

29 CFR  1910.303(b)(2): Listed or labeled electrical equipment was not used or installed in accordance with instructions included in the listing or labeling:  a)  automotive dismantling bay: On or about November 20, 2024, and at times prior, the employer exposed employees to electrical shock hazards in that THHN 12-2 wire was run outdoors while feeding power to individual automotive lifts.  THHN 12-2 wire is not listed or labeled for that use and cannot be used outdoors.  b)  automotive repair bay: On or about November 20, 2024, and at times prior, the employer exposed employees to electrical shock hazards in that THHN 10-2 wire was run outdoors while feeding power to an individual automotive lift.  THHN 10-2 wire is not listed or labeled for that use and cannot be used outdoors.

29 CFR  1910.305(g)(2)(ii): Flexible cords were not used only in continuous lengths without splice or tap:  a) automotive dismantling bay lift# 2; On or about November 20, 2024 and at times prior, the employer exposed employees to 220v electrical hazards in that employees were allowed to walk and work around an Atlas automotive lift that had the power cord spliced but did not retain the insulation, outer sheath properties, and usage characteristics of the cord(s) being spliced.   b) automotive repair bay lift# 5; On or about November 20, 2024 and at times prior, the employer exposed employees to 220v electrical hazards in that employees were allowed to walk and work around an Atlas automotive lift that had the power cord spliced but did not retain the insulation, outer sheath properties, and usage characteristics of the cord(s) being spliced.
