29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) New Construction at The Palisades at Sawnee Village, Lot #12 Skytop Drive, Cumming, GA 30040, Roof: On or about 11/22/2024, the employer exposed an employee to fall hazards of approximately 24 feet to the lower ground level, in that, a fall protection system was not provided to employees engaged in framing and sheathing activities on a 6/12 pitched roof. b) New Construction at The Palisades at Sawnee Village, Lot #12 Skytop Drive, Cumming, GA 30040, In second level rear window rough opening: On or about 11/22/2024, the employer exposed an employee to fall hazards of approximately 15 feet to the lower ground level, in that a fall protection system was not provided to employees performing plywood sheathing outside the window opening.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed. a) New residential construction located on Lot #12 Skytop Drive, Cumming, GA 30040, Stairwell between first and second levels: On or about 11/22/2024, the employer exposed employees to fall hazards of approximately 10-feet, 6-inches to the lower concrete slab, in that a ladder with side rails extended 3-feet past the second level landing was not provided as the ladder used did not reach the second level in a location where employee accessed the second floor and ground level to perform framing installation activities.
