OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by and caught between hazards while servicing automobiles without properly inspected and maintained automotive lifts. a) Service Shop: On or about November 25, 2024, and at times prior to, employees used automotive lifts that made unusual noises, had cracked hoses, frayed cables, were missing lifting pads, or had broken or missing safety locks, thereby exposing employees to struck-by and caught between hazards.

29 CFR 1910.1200(h)(1):Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (a) Service Shops: On or about November 25, 2024, and times prior to, the employer exposed employees to health hazards, in that employees were not trained on the hazards of chemicals with which they worked, including heptane-containing Kex Tire Repair Cement, and hexane-containing IES Battery Protector.
