29 CFR 1926.602(d): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178:   29 CFR  1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).   a) Located at 1493 Billingham Drive Grove City, OH 43123: On and about November 27, 2024, the employer did not ensure that the operator of the JLG 10042 all-terrain forklift had received training and evaluation prior to operating the lift to position gables onto the roof of a new construction home.

29 CFR  1926.20(b)(2):Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  a) Located at 1493 Billingham Drive Grove City, OH 43123: On or about November 27, 2024, the employer did not conduct frequent and regular inspections of the job site. As a result, employees were exposed to fall hazards greater than 18 feet while performing residential construction.

29 CFR  1926.100(a):Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  a) Located at 1493 Billingham Drive Grove City, OH 43123: On or about November 27, 2024, the employer did not ensure employees were protected from head injury from falling objects while lifting gables overhead. Employees did not have protective helmets.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a) Located at 1493 Billingham Drive Grove City, OH 43123: On or about November 26, 2024, the employer did not ensure that employees framing were protected from falling by a fall protection system. As a result, employees were exposed to a fall hazard of greater than 18 feet while performing residential construction.
