1910.140(d)(2)(ii) 29 CFR 1910.49(d)(2)(ii): The employer did not ensure that personal fall arrest systems are rigged in such a manner that the employee cannot free fall more than 6 feet (1.8 m) or contact a lower level. A free fall may be more than 6 feet (1.8 m) provided the employer can demonstrate the manufacturer designed the system to allow a free fall of more than 6 feet and tested the system to ensure a maximum arresting force of 1,800 pounds (8 kN) is not exceeded. 29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling by guardrail systems, safety net system, or personal fall arrest system: 555 Hubbard Ave. Pittsfield, MA: On or about November 15, 2024, employees were exposed to fall hazards between the heights of 4 feet 5 inches and 11 feet 8 inches above a lower level and not protected from falls while performing maintenance work on material racking systems.

29 CFR 1910.30(a)(1): The employer did not provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart before any employee is exposed to a fall hazard: 555 Hubbard Ave. Pittsfield, MA: On or about November 15, 2024, employees were exposed to fall hazards of approximately 4 feet 5 inches and 11 feet 8 inches above a lower level while working unprotected performing maintenance activities on a metal racking system, and the employer did not ensure that each employee was able to recognize fall hazards and how to control or eliminate them.
