OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a) On or about December 3, 2024, on the west side of the jobsite, where employees engaged in concrete pouring activities were working beneath and in proximity to the boom of the concrete pumping truck. b) On or about December 3, 2024, on the west side of the jobsite, employees engaged in concrete pouring activities were exposed to a struck by hazard where a concrete pump truck was set up on previously disturbed soil of unknown stability.
