OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards:  a) On or about December 3, 2024, on the west side of the jobsite, where employees engaged in concrete pouring activities were working beneath and in proximity to the boom of the concrete pumping truck.  b) On or about December 3, 2024, on the west side of the jobsite, employees engaged in concrete pouring activities were exposed to a struck by hazard where a concrete pump truck was set up on previously disturbed soil of unknown stability.

29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury.  a) On or about December 3, 2024, on the west side of the jobsite, employees guiding the concrete pump hose were not effectively trained regarding the safe operation of the hose.

29 CFR  1910.1200(g)(8):  The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s):  a)  On or about December 3, 2025, at the job site, where employees pouring concrete which contained chemicals such as, but not limited to, Polychem SA-50 and Polychem 400NC without having access to safety data sheets.
