OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to crushed-by and struck-by hazards from falling loads when using an overhead crane with an underhung hoist to move batteries: On or about December 4, 2024, and at times prior, in the battery charging area, the employer did not ensure the Chester Hoist, s/n: WC3536, was taken out of service when an inspection identified the brake shaft was cracked and broken, exposing employees to crushing and struck-by hazards from falling loads. Employees were exposed to crushing injuries when using an electric chain hoist attached to the Chester Hoist to lift and move powered industrial vehicle batteries weighing between 882 pounds and 2,340 pounds during battery changes. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.132(d)(1)(i): When the employer had assessed the workplace hazard(s) and determined that hazard(s) were present, the employer did not select and/or have each affected employee use, the types of personal protective equipment that would protect the affected employee(s) from the hazards identified in the hazard assessment: On or about December 4, 2024, and at times thereafter, the employer did not ensure employees working in the battery room and tasked with activities such as but not limited to checking battery electrolyte levels and adding fluids to batteries, wore personal protective equipment such as but not limited to face shields, chemical resistant aprons and chemical resistant gloves to protect from hazards associated with contact with sulfuric acid which is contained in the batteries.
