29 CFR  1910.147(c)(1):The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  (a) On or about December 5, 2024, employees which conduct blade changes on saws and the pallet dismantler, were not provided with a hazardous energy control program that included training, procedures, and periodic inspections.

29 CFR  1910.147(c)(7)(i): The employer did not provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees:  (a) On or about December 5, 2024, employees who conduct blade changes on saws and the pallet dismantler, were not provided with training on the hazardous energy control program and procedure to control hazardous energy sources.

29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a) On or about December 5, 2024, at 7320 West Florist Avenue in Milwaukee, Wisconsin, employees engaged in pallet recycling and manufacturing work were exposed to hazardous materials, such as but not limited to, LP gas (forklift fuel), motor oil, spray paints, and lubrication oil (for pneumatic tools). The employer had not developed and implemented a program which would address labeling and other forms of warnings on hazardous material containers, Safety Data Sheets, and employee information and training on the hazards associated with the hazardous materials utilized on site, and is consistent with Globally Harmonized System (29 CFR 191200(a)(1)).  The written program must also contain the following: 1. A list of all hazardous materials on site; 2. The methods the employer will use to inform employees of the hazards associated with non-routine tasks involving hazardous materials, such as spills, and; 3. The method the employer will use to inform other employers (contractors) of the chemicals their employees might be exposed to while performing duties at the site.

29 CFR  1910.132(d)(1):The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment:  (a) On or about December 5, 2024, the employer did not conduct and certify that a hazard assessment was conducted for job task that required the use of personal protective equipment, such as, but not limited to; safety glasses when using saws and pneumatic nail guns, and gloves for handling unfinished wood materials.
