OSH ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employee(s) were exposed to struck-by, impact, and caught-between hazards when operating a powered industrial vehicle without utilizing the operator's seat restraint: (a) On or about November 21, 2024, employees were exposed to struck-by, impact, and caught-between hazards when operating Palfinger Model FHS 55-4WP forklift (truck-mounted type, serial No. 1100200412) for material handling tasks in the yard such as, but not limited to, moving loads of lumber between locations and loading/unloading trailers. The operator's seat belt was not used during these tasks to restrain the operator in the seat in the event of a sudden stop, tip-over, roll-over, etc. An incident resulting in a serious head injury occurred when the forklift tipped forward and the employee was thrown at the overhead cage's element (rollover bar).
