29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) On or about December 6, 2024, at Lot #1 Rojan Meadows and North Little Creek Road, Dover, De 19901- The general contractor did not provide fall protection for employees that were exposed to fall hazards with working on a timber framed residential structure. The exposed employees were observed by the General Contractor in plain sight and did not correct the exposure. The General Contractors Superintendent was on the site and refused to respond to the CSHO 's question about the exposed employee's safety. The employees were observed walking and working on the timber framed residential structure at elevations of over 12 feet without fall protection. b) On or about December 6, 2024, at Lot#1 Rojan Meadows and North Little Creek Road, Dover, De 19901- Employees were observed walking and working from an elevated platform without the use for fall protection at an elevation of over 24 feet without fall protection.

29 CFR 1926.602(c)(1)(ii): No modifications or additions which affect the capacity or safe operation of the equipment shall be made without the manufacturer's written approval. If such modifications or changes are made, the capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. In no case shall the original safety factor of the equipment be reduced. a) On or about December 6, 2024, at Lot #2 Rojan Meadows and North Little Creek Road, Dover De 19901 - Employees were observed in plain sight of the site superintendent walking and working from an elevated platform of a construction telehandler that had been modified to be an unsupported makeshift platform at an elevation of over 24 feet from the ground.
