OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from struck by and caught in between hazards while riding the rear step of waste collection trucks:  a) Bellvale Lakes Road, Warwick, NY - On or about December 5, 2024 and at times prior thereto, while picking up recycling waste an employee stood on the rear step on the passenger's side of a rear load recycling truck as the truck traveled along the north-bound lane. The truck stopped at the residences along the lane so that the employee riding the rear step could exit the rear step to collect containers and empty waste into the back of the truck before getting back on to the step. Speed data reports from the truck indicate that the truck traveled at speeds of up to 16 mph.  The employee riding the rear step was exposed to struck-by and caught-in-between hazards while riding the riding step of the truck as it traveled at speeds more than 10 mph and during snow and ice weather conditions. The employee riding the rear step got caught-in-between the truck and a telephone pole when the truck skidded off the roadway while it was traveling.  NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION AND DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
