29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) On or about December 6, 2024, At Lot# 48 Wynkoop Way, Eden Hill Development, Dover, Delaware 19901- CSSHO observed employees engaging in walking and working on the top of the timber framed residential structure without the use of any fall protection measures.  The competent person was observed climbing over the roof trusses without fall protection.  The Nava Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 11926.501(b)(13), which was contained in OSHA inspection number 1680403, citation number 01003, item number 3 and was affirmed as a final order on 01/23/2024, with respect to a workplace located at Lot#18 at the corner of Ediman Ct and Kennison Ln in Seabrook Village, Camden, DE 19934.

29 CFR 1926.602(c)(1)(ii): No modifications or additions which affect the capacity or safe operation of the equipment shall be made without the manufacturer's written approval. If such modifications or changes are made, the capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. In no case shall the original safety factor of the equipment be reduced.   a) On or about December 6, 2024, at Lot# 48 Wynkoop Way, Dover, De 19901- Employees were observed walking and working from an elevated platform of a construction telehandler that had been modified to be an unsupported makeshift platform at an elevation of over 18 feet from the ground.
