29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  At the jobsite located at 5717 Walmer St Mission Kansa, employees were exposed to chemical hazards. Employees engaged in concrete chipping activities were exposed to dermal, ingestion, and inhalation hazards from exposure to gasoline. The employer had not developed and implemented a hazard communication program.

29 CFR  1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:   At the jobsite located at 5717 Walmer St, Mission Kansas, employees were exposed to chemical hazards. Employees engaged in roofing activities were exposed to dermal, ingestion, and inhalation hazards from exposure to hazardous chemicals without being provided with information and training on how to recognize, avoid and/or eliminate the hazards associated with the gasoline.

The employer did not have safety data sheets for the gasoline that employees use.

29 CFR 1926.102(a)(1): Employees did not use eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  At the temporary job site located at 5717 Walmer St. Mission, Kansas , employees engaged in residential framing activities were exposed to struck-by hazards while using a pneumatic nail gun in that eye protection was not provided or utilized.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  Employee(s)working at 5717 Walmer St. Mission Kansas were exposed to fall hazards of approximately 11 ft the aluminum ladders used to access the roof did not extend at least 3 feet above the eve of the roof. The ladder was extended approximately 1 foot.
