29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) In the Finishing Area, on or about December 10, 2024 - The employer failed to administer a continuing hearing conservation program, including maintaining an audiometric testing program and providing a variety of suitable hearing protectors when a Finisher's noise exposures exceeded a dose of fifty percent while grinding, sanding, and filing aluminum railings. The Finisher was exposed to noise at an 8-hr TWA of 87.4 decibels on the A-scale or equivalently a dose of 70.1% during a 463-minute sampling period on January 7, 2025 while finishing aluminum railings. b) In the Finishing Area, on or about December 10, 2024 - The employer failed to administer a continuing hearing conservation program, including providing a variety of suitable hearing protectors when a Finisher's noise exposures exceeded a dose of fifty percent while grinding, sanding and filing aluminum railings. The Finisher was exposed to noise at an 8-hr TWA of 88.3 decibels on the A-scale or equivalently a dose of 78.6% during a 421-minute sampling period on January 7, 2025 while finishing aluminum railings.
