29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: On or about December 10, 2024, subcontracted employees were exposed to a fall hazard of 11.3 feet while installing shingles on residential home located at 35997 Falcon Crest Ave, AVON, OH 44011. Subcontracted employees were using an extension ladder to access the roof, and the controlling employer did not ensure it extended at least 3 feet above the upper landing surface.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On or about December 10, 2024, the controlling employer did not ensure that subcontracted employees engaged in the installation of shingles on a 9/12 pitch residential roof located at 35997 Falcon Crest Ave, AVON, OH 44011, were protected from falling 11.3 feet to the ground below by guardrail systems, safety net systems, or personal fall arrest systems. Ortico Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.501(B)(13) Duty to have fall protection), which was contained in OSHA inspection number 1476356, citation number 01, item number 01 and was affirmed as a final order on (6/16/2020), with respect to a workplace located at 5253 Wedgewood Dr., MEDINA, OH 44256. Ortico Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.501(b)(13), which was contained in OSHA inspection number 1732418, citation number 1, item number 1 and was affirmed as a final order on 5-16-2024, with respect to a workplace located at 3804 Heron Watch DR, AKRON, OH 44319.
